The court has signaled that Judge Walker will rule Wednesday on whether Proposition 8, California's voter-approved ban on same-sex marriage, violates the U.S. Constitution.
Judge Walker will issue his opinion electronically, without a hearing, between 1 and 3pm.
As expected, lawyers for both sides are already getting ready for a continuing legal battle after Walker releases his decision. Attorneys defending Prop. 8 have filed a motion with the court asking Walker to delay enforcing his order pending an appeal—if he rules against them. The lawyers trying to overturn the same-sex marriage ban have also promised an appeal if they lose the case.
