Yesterday I mentioned the defense attorneys' complaints about the impartiality of Judge Vaughn Walker. Well, this morning plaintiffs' attorney David Boies resumed his grilling of defense witness Kenneth Miller about politics and religion. After yet another contentious exchange between Boies and Miller, defense attorney David Thompson rose to request a break. After two and a half hours of cross-examination, he said, the witness needed a break. To which Judge Walker replied: "There's something about pots and kettles complaining about long cross-examinations," Walker said in a sarcastic reference to very lengthy crosses by the defense attorneys. No doubt that added to the perception by Prop. 8 attorneys that the playing field in this courtroom is not exactly level.
